December 14, 2021 Opinion or Order MINUTE ORDER: In Civil Action No. 21-cv-3240, Plaintiff has filed a notice of related case, Dkt. #2 , in which she asserts that Civil Action No. 21-cv-3240 is related to Civil Action No. 13-cv-1582. Pursuant to LCvR 40.5(a), civil cases are "deemed related when the earliest is still pending on the merits in the District Court and they (i) relate to common property, or (ii) involve common issues of fact, or (iii) grow out of the same event or transaction or (iv) involve the validity or infringement of the same patent." In No. 13-cv-1582, the "only claim before the Court is an Administrative Procedure Act... claim seeking to compel FEMA to comply with the EEOC's order" awarding backpay to Plaintiff. Farrington v. Nielsen, 297 F. Supp. 3d 52, 54 (D.D.C. 2018). No. 21-cv-3240, by contrast, raises a retaliation claim pursuant to Title VII of the Civil Rights Act. Dkt. #1 at 7 (Compl. 43-44). In light of the apparent differences between the two cases and the apparent lack of common issues of fact or a common underlying event or transaction, the Court hereby ORDERS the parties to file a joint status report in both Civil Action 21-cv-3240 and Civil Action No. 13-cv-1582, on or before January 6, 2022, addressing whether (and, if so, how) the two cases satisfy the requirements of Local Rule 40.5(a).
