June 10, 2021 Opinion or Order MINUTE ORDER granting #8 Motion for Leave to File. Petitioner has filed a motion for leave to file a supplemental exhibit to its reply. ECF No. 8. Respondents do not object to the inclusion of the proposed exhibit in the record before the Court, but do object to the extent that th[e] motion [accompanying it] is a sur-reply or include[s] additional facts, argument or case law beyond those argued in the Reply. Id. at 1 (third alteration in original). The Court has reviewed the supplemental exhibit and the brief accompanying it and finds that the brief neither constitutes a sur-reply nor includes additional factual or legal arguments beyond those included in Petitioners reply. Rather, the submission describes the supplemental exhibit, which was already referred to in Petitioners reply (see ECF No. 7 at 14), and explains why it supports arguments already made in that reply (ECF No. 8 at 2). Moreover, the exhibit was not attached to the reply only to give Respondents the opportunity to review it to determine if it included any privileged or protected information. ECF No. 8 at 2. That review has been completed and it does not. Id. Accordingly, it is hereby ORDERED that Petitioners motion for leave to file a supplementary exhibit (ECF No. 8) is GRANTED, and the exhibit and its accompanying brief shall be deemed filed as of the date of this Minute Order.
