January 31, 2022 Opinion or Order MINUTE ORDER: The Court is in receipt of Plaintiff's #6 Motion for Case Management/Electronic Case Files (CM/ECF) Username and Password. His third such motion, Plaintiff indicates that he has adequate Internet access and has completed the Clerk's Office e-filing tutorial, thus complying with LCvR 5.4. However, as the Court explained in its January 24, 2022 Minute Order, Plaintiff has demonstrated sufficient ability to file pleadings on the docket without e-filing privileges. Additionally, at this early stage of the case, it does not appear that Plaintiff would be prejudiced without CM/ECF access. Accordingly, Plaintiff's #6 Motion is DENIED WITHOUT PREJUDICE. January 24, 2022 Opinion or Order MINUTE ORDER: The Court has received Plaintiff's #4 Motion for Access to Case Management/Electronic Case Files (CM/ECF). Pursuant to Local Rule of Civil Procedure 5.4(b), a "pro se party may obtain a CM/ECF user name and password from the Clerk with leave of Court." The decision whether to grant the motion "is within the discretion of the judge to whom the case is assigned." The Motion must describe the partys access to the internet and certify that he "either has successfully completed the entire Clerk's Office on-line tutorial or has been permitted to file electronically in other federal courts." LCvR 5.4(b)(2). Plaintiff neither describes his internet access nor certifies that he has completed the Clerk's Office on-line tutorial. Moreover, so far in the short history of this case, Plaintiff has demonstrated sufficient ability to file pleadings on the docket. The Clerk will continue to mail copies of all orders to Plaintiff, and all defendants must ensure that each filing is served upon Plaintiff at his address of record under the Federal and Local Rules. Although the public counter is currently closed, the Clerk's Office remains open and continues to accept papers during the COVID-19 pandemic. Finally, to address any concerns regarding deadlines for filings, the Court will take into account Plaintiff's pro se status and lack of CM/ECF access in setting deadlines when appropriate under the Federal and Local Rules. Accordingly, it is hereby ORDERED that Plaintiff's #4 Motion is DENIED WITHOUT PREJUDICE. The Clerk of Court is directed to mail a copy of this minute order to Plaintiff at his address of record.
