MINUTE ORDER: Under Federal Rule of Civil Procedure 12(h)(3), "[i]f [a] court determines at any time that it lacks subject-matter jurisdiction, the court must dismiss the action." As the Court indicated in its Minute Order of December 23, 2022, it appears the House Select Committee has completed and released its Final Report, and as of today, it has expired along with the 117th Congress. Thus, the subpoena Plaintiffs filed this lawsuit to quash has expired as well. Thus, the case is moot. Accordingly, it is hereby ORDERED that this case is DISMISSED for lack of subject-matter jurisdiction. The Clerk of Court is directed to close the case. Signed by Judge Timothy J. Kelly on 1/3/2023.
