MINUTE ORDER: Upon consideration of #9 defendant 1434 Park Road LLC's consent motion for extension of time to file responsive pleading, and the entire record herein, it is hereby ORDERED that the motion is granted. Pursuant to Federal Rule of Civil Procedure 6(b)(1)(B), the Court finds that defendant failed to respond to #1 the complaint because of excusable neglect. The delay in this case is minimal and has had no impact on the case; granting defendant an extension would not prejudice plaintiff (as evidenced by plaintiff's consent to the motion); and defendant's explanation for its failure to respond to #1 the complaint indicates that defendant has not acted in bad faith. It is further ORDERED that defendant 1434 Park Road LLC shall answer or otherwise respond to #1 the complaint by not later than May 31, 2022. SO ORDERED. Signed by Judge John D. Bates on 5/18/2022.
