Filing 4 ORDER: For the reasons stated in the Court's Memorandum Opinion, Dkt. #3 , it is hereby ORDERED that (1) the motion for leave to file an amended complaint, Dkt. #2 , is DENIED as futile; (2) the complaint, Dkt. #1 , is DISMISSED without prejudice for failure to allege facts sufficient to sustain subject-matter jurisdiction in this Court; and (3) judgment is hereby ENTERED in favor of Defendants. This Order constitutes a final judgment of the Court within the meaning of Rule 58(a) of the Federal Rules of Civil Procedure. The Deputy Clerk of Court is directed to terminate the case.
