MINUTE ORDER granting Defendant's #9 Motion for an Extension of Time. Before the Court is Defendant's #9 motion for an extension of time to answer the complaint and to respond to Plaintiffs' #7 motion for summary judgment, which Plaintiffs filed a month before Defendant's answer deadline. Defendant seeks an approximately three-month extension of its deadline to respond to the motion--which it argues is premature--primarily because counsel for Defendant was only just assigned to this matter. Plaintiffs oppose the motion, contending a 45-day extension would suffice. Upon consideration of Defendant's motion, Plaintiffs' opposition, and Defendant's reply, it is hereby ORDERED that, nunc pro tunc and for good cause shown, Defendant's motion is GRANTED. It is further ORDERED that Defendant shall respond to Plaintiffs' #7 motion for summary judgment and file any cross-motion for summary judgment by July 14, 2023, which per the parties agreement may serve as Defendant's response to the #1 complaint. It is further ORDERED that, by May 4, 2023, the parties shall jointly propose a schedule governing the outstanding summary judgment briefing deadlines, including Plaintiffs' reply in support of their motion and response to any cross-motion and Defendant's reply in support of any cross-motion.
