Date Filed Document Text
April 7, 2023 Opinion or Order MINUTE ORDER (paperless) DISMISSING petitioner's #1 Petition for Writ of Habeas Corpus. The defendant's nonsensical filing appears to rest upon defendant's adherence to the "sovereign citizen" ideology, which "center[s] on a confused distinction between a 'living' person and a 'corporate' or 'artificial' person, premised on the mistaken belief that the Fourteenth Amendment creates the latter class of citizenship and releases the former from the jurisdiction of the federal government and the governments of the several States." United States v. Brown, Case No. 22-170 (CKK), 2022 WL 2828996, *3 (D.D.C. July 20, 2022). Defendant's petition appears to claim that this Court lacked authority over his criminal case, because this Court "should have been a court of record but instead fraudulently concealed its jurisdiction under color of law," among other, difficult-to-parse claims, see #1 Petition at 5. To the extent petitioner disputes this Court had personal jurisdiction over his criminal case, "the mere fact that the defendant was within the territory of the United States at the time of the alleged criminal action is 'the beginning and the end of the jurisdictional inquiry.'" Id. (quoting United States v. Underwood, 726 F. App'x 945, 948 (4th Cir. 2018)). Accordingly, petitioner's #1 Petition is DISMISSED. The Clerk of Court is ordered to close the case. Signed by Judge Beryl A. Howell on April 7, 2023. (lcbah3)
