Cases Consolidated. Case 23cv1584 has been consolidated with case 19mc190, pursuant to Minute Order filed 7/17/2023. From this date forward, all pleadings shall be filed ONLY in the lead case, Misc. Action No. 19-190. Parties are advised NOT to elect the SPREAD TEXT option when filing in ECF, as this will result in repetitive docketing. (znmw) |
MINUTE ORDER. Pursuant to Federal Rule of Civil Procedure 42 and the parties' Joint Report 251 , the Clerk of Court is directed to CONSOLIDATE the following three cases into 19-mc-190 and to STAY the underlying cases: Baptist Hospital, Inc. v. Becerra, 23-cv-1584, Paulding Medical Center, Inc. v. Becerra, 23-cv-1585, and Alta Bates Medical Center v. Becerra, 23-cv-1602. Given that all counts in Baptist Hospital, Inc. and Paulding Medical Center, and that Count II in Alta Bates Medical Center, challenge CMS Ruling 1739-R, it is ORDERED that those claims are STAYED pursuant to the January 14, 2022 Stay Order 185 . Further, given that the claims in Count I of Alta Bates Medical Center raise both Allina II-type claims, which the parties agree are subject to remand under the January 19, 2021 Remand Order 74 , and pre-October 1, 2004 claims, which they agree are subject to remand under the August 30, 2021 Remand Order 131 , it is ORDERED that Count I of the Alta Bates matter is REMANDED pursuant to those orders. Notwithstanding the stay, plaintiffs must complete service of process on defendant in the underlying cases, if that has not already been accomplished. SO ORDERED.
