MINUTE ORDER (paperless) REMANDING this matter to D.C. Superior Court. A defendant may "remove any criminal prosecution from a State court" by "filing in the district court... a notice of removal signed pursuant to Rule 11 of the Federal Rules of Civil Procedure and containing a short and plain statement of the grounds for removal, together with a copy of all process, pleadings, and orders served upon such defendant... in such action." 28 U.S.C. 1455(a); see also id. 1451(1) (noting that "State court" "includes the Superior Court of the District of Columbia"). While defendant instituted the instant action by filing a #1 Notice of Removal of the D.C. Superior Court action 2023 CCC 000025, that filing does not comport with the requirements of removed state criminal actions, in that it includes neither a "short and plain statement of the grounds for removal," which are indiscernible from the record, nor a copy of the necessary papers from the D.C. Superior Court action. See id. 1455(a). The removal statute specifies that "[i]f it clearly appears on the face of the notice [of removal] and any exhibits annexed thereto that removal should not be permitted, the court shall make an order for summary remand." Id. 1455(b)(4). As such, in light of the aforementioned deficiencies, this matter is REMANDED to D.C. Superior Court. The Clerk of Court is directed to close this case. Signed by Judge Beryl A.
