Filing 4 RESPONSE TO ORDER TO SHOW CAUSE re Order,,,,, filed by SIRITA PAYTON. (Attachments: #1 Text of Proposed Order)(Dansie, William) |
Set/Reset Deadlines: Response to Show Cause due by 9/13/2023. (zed) |
MINUTE ORDER TO SHOW CAUSE: Plaintiff cites to several provisions of the D.C. Code, 42 USC 1983, and the 14th amendment to allege that this court has subject matter jurisdiction over her claims. But none appear to provide this court with jurisdiction. Instead, 11-921 explains that the Superior Court for the District of Columbia has jurisdiction over certain civil actions brought in the District of Columbia, 13-423 describes how a District of Columbia court may exercise personal jurisdiction over a person or entity, 12-101 describes survival of rights on "the death of a person in whose favor or against whom a right of action has accrued," and 16-2071 does not appear to be a provision in the D.C. Code. Although Plaintiff also cites to 42 USC 1983, she does not allege the violation of a federal right. Likewise, Plaintiff has failed to allege any violations of the 14th amendment. Thus, it appears from the record that the court does not have subject matter jurisdiction over the claims. Therefore, it is hereby ORDERED that Plaintiff SHOW CAUSE, in writing, on or before 9/13/2023 why this action should not be dismissed for lack of subject matter jurisdiction. Should Plaintiff fail to satisfactorily respond to the present order by 9/13/23, the court may dismiss this action without further notice. Signed by Judge Tanya S. Chutkan on 8/31/23. (lca) |
