September 18, 2023 Opinion or Order MINUTE ORDER granting Plaintiff's #11 Motion to Extend Due Date of Plaintiff's Opposition to Defendant's #8 Motion to Dismiss Until this Court Has Ruled on Plaintiff's #10 Motion to Remand. Plaintiff moves to extend the deadline for her to respond to Defendant's #8 Motion to Dismiss until the Court resolves Plaintiff's #10 Motion to Remand to District of Columbia Superior Court. ECF No. 11 at 1. She invokes Federal Rule of Civil Procedure 6(b), under which the Court may extend a deadline for good cause, "with or without motion." See Fed. R. Civ. P. 6(b)(1)(A); ECF No. 11 at 4. Courts simultaneously facing both motions to remand and motions to dismiss routinely stay briefing on the latter, sometimes doing so sua sponte. See, e.g., Animal Legal Def. Fund v. Hormel Foods Corp., No. 16-cv-1575 (CKK) (D.D.C.), Minute Order of September 19, 2016 (staying motion-to-dismiss briefing sua sponte); Washington Consulting Grp., Inc. v. Raytheon Tech. Servs. Co., LLC, No. 10-cv-265 (JDB) (D.D.C.), Minute Order of April 23, 2010 (staying motion-to-dismiss briefing "[u]pon the Court's own motion"); cf. Jenkins v. Howard Univ., No. 22-cv-874 (RC), 2023 WL 1070552, at *1, 5 (D.D.C. Jan. 27, 2023) (denying as moot the plaintiffs' motion to stay, which had been filed eight months earlier, only after denying their motion to remand--essentially affording the plaintiffs the desired relief in the motion to stay). Pressing pause on the motion-to-dismiss briefing makes sense here, too, because Plaintiff's #10 Motion to Remand calls into question the Court's subject-matter jurisdiction, which the Court must resolve before it could turn to Defendant's #8 Motion to Dismiss. Thus, it is hereby ORDERED, nunc pro tunc to September 13, 2023, that Plaintiff's #11 Motion is GRANTED. It is further ORDERED that Plaintiff shall file her opposition to Defendant's #8 Motion to Dismiss within 14 days of the Court's order resolving Plaintiff's #10 Motion to Remand.
