MINUTE ORDER. In its October 14, 2023 minute order, the Court indicated its inclination to consolidate this case with 23-cv-1346. The Court requested any objections on or before October 21, 2023, and neither party filed an objection. See Minute Order of Oct. 14, 2023. Upon consideration of the "common question[s] of law or fact" in this case and 23-cv-1346, the Court concludes that consolidation of the two cases is appropriate. Fed. R. Civ. P. 42(a); see Nat'l Ass'n of Mortg. Brokers v. Bd. of Governors of Fed. Rsrv. Sys., 770 F. Supp. 2d 283, 286 (D.D.C. 2011). The Clerk of Court is hereby directed to consolidate 23-cv-1346 and 23-cv-2756. The Clerk of Court is further directed to docket the plaintiff's #1 Complaint on the 23-cv-2756 docket as the plaintiff's Second Amended Complaint on the 23-cv-1346 docket. MINUTE ORDER. In light of this case's reassignment, see Dkt. 8, the Court is considering a sua sponte consolidation of this case with 23-cv-1346 because both cases appear to "involve a common question of law or fact." Fed. R. Civ. P. 42(a); see Nat'l Ass'n of Mortg. Brokers v. Bd. of Governors of Fed. Rsrv. Sys., 770 F. Supp. 2d 283, 286 (D.D.C. 2011) ("Pursuant to Rule 42(a), a district court has authority to order consolidation when actions involving a common question of law or fact are pending before the court. Consolidation pursuant to Rule 42(a) is permissive and vests a purely discretionary power in the district court, which may consolidate related cases sua sponte." (cleaned up)). On or before October 21, 2023, the parties shall file any objections to consolidation under Rule 42(a). So Ordered by Judge Dabney L. Friedrich on October 14, 2023. (lcdlf2)
