MINUTE ORDER: Plaintiff has failed to properly serve General Dynamics Information Technology ("GDIT"). Under Federal Rule of Civil Procedure 4(e), a corporation may be served according to the "state law for serving a summons" "in the state where the district court is located." Fed. R. Civ. P. 4(e)(1); see also Fed. R. Civ. P 4(h)(1)(A) (explaining that a corporation may be served "in the manner prescribed by Rule 4(e)(1) for serving an individual"). District of Columbia law permits corporations to be served by certified mail but requires the mail to be sent "return receipt requested," Sup. Ct. R. D.C. 4(c)(4), and the signed receipt to be attached to an affidavit filed with the Court, id. 4(l)(B). Furthermore, among other requirements laid out in Rule 4(l)(B), either the return receipt must be signed by the party named in the summons or the accompanying affidavit must state "specific facts from which the court can determine that the person who signed the receipt meets the appropriate qualifications for receipt of process." Id. 4(l)(B)(iv). Plaintiff has not attached a signed return receipt to his affidavit. Plaintiff shall have until January 15, 2024 to file proof of proper service--whether by certified mail return receipt requested or other means, such as through a professional process server. Failure to file proof of proper service may result in dismissal of the claims against GDIT. SO ORDERED by Judge Christopher R. Cooper on 12/1/2023. (lccrc3) |
