MINUTE ORDER. The Court is in receipt of Defendant United States of America's #4 Status Report, in which they indicate that they plan to file a motion to dismiss but need additional time to gather support for said motion, including declarations from the Department of Labor should it be determined that this case is covered by the Federal Employees' Compensation Act. Due to counsel's trial schedule, they request a filing deadline of December 22, 2023. The Court ORDERS that Defendant shall file a motion to dismiss or otherwise respond to Plaintiff's complaint by no later than DECEMBER 22, 2023; Plaintiff shall then respond by JANUARY 12, 2024; Defendant shall then file a reply by JANUARY 19, 2024.The Clerk of Court is instructed to send a copy of this order to Plaintiff's address of record.
