MINUTE ORDER. The Court is in receipt of Plaintiff's #6 Motion to Amend Complaint, in which he moves to amend the #1 Complaint based on what he alleges is "new evidence" against Defendants. Plaintiff has not yet filed proof of service of the original Complaint; he may amend his Complaint according to Federal Rule of Civil Procedure 15(a)(1). The Court will therefore GRANT Plaintiff's #1 Motion as he can amend his Complaint as of right.The Clerk of Court is instructed to send a copy of this order to Plaintiff's address of record. MINUTE ORDER. The Court has received Plaintiff's #5 Motion for CM/ECF Username and Password. Pursuant to Local Rule of Civil Procedure 5.4(b), a "pro se party may obtain a CM/ECF user name and password from the Clerk with leave of Court." The decision whether to grant the motion "is within the discretion of the judge to whom the case is assigned." The Motion must describe the party's access to the internet and certify that he "either has successfully completed the entire Clerk's Office on-line tutorial or has been permitted to file electronically in other federal courts." LCvR 5.4(b)(2).Plaintiff failed to include that information in his #5 Motion. Furthermore, in the short history of this case so far, Plaintiff has demonstrated sufficient ability to file pleadings on the docket. Therefore, in an exercise of the Court's discretion, Plaintiff's #5 Motion is DENIED WITHOUT PREJUDICE. The Clerk of Court will continue to mail copies of docket entries to Plaintiff and, if necessary, Chambers will provide courtesy copies via email.
