MINUTE ORDER. Under Rule 12(b) of the Federal Rules of Civil Procedure, "a party may assert" the defense of "failure to state a claim upon which relief can be granted" "by motion." "A motion asserting" this "defense[] must be made before pleading if a responsive pleading is allowed." Fed. R. Civ. P. 12(b). Here, the defendant filed its answer, which "requests that Plaintiff's Amended Complaint, and any amendment thereto, be dismissed with prejudice" for failure to state a claim. Answer at 3, Dkt. 3. If the defendant seeks dismissal of the amended complaint for failure to state a claim, it shall file a motion to dismiss on or before December 5, 2023. So Ordered by Judge Dabney L.
