MINUTE ORDER granting #4 Partial Motion to Dismiss: Upon review of the motion, and in light of Plaintiff's consent to the dismissal of Counts I and II of the complaint, the Court hereby GRANTS Defendant's partial motion to dismiss. It is further ORDERED that Counts I and II of the complaint, which arise under 42 U.S.C. 1981, are DISMISSED.
