MINUTE ORDER granting Plaintiff's opposed #43 Motion to Continue Stay of Order on Motion to Seal. On January 29, 2024, the Court denied without prejudice Plaintiff's #28 motion to seal and to designate particular materials "outside attorneys' eyes only" in conjunction with its motion for a preliminary injunction. Since then, the Court has granted Plaintiff's requests to temporarily stay the unsealing and de-designation of those documents pending resolution of its #43 motion, which also delayed the resolution of its preliminary injunction motion. See Minute Orders of January 29, 2024 and January 30, 2024. Given the alleged risk of harm to third parties and Plaintiff's representations about the contents of its renewed motion, the Court will continue its stay to allow Plaintiff an opportunity to submit that motion. Accordingly, it is hereby ORDERED that Plaintiff's #43 motion is GRANTED, and the documents attached to the parties' #28 , #35 , #36 motions to seal and that are the subject of the Court's #40 Memorandum Opinion and Order shall remain under seal and be maintained on an "outside attorneys' eyes only" basis until further order of the Court. It is further ORDERED that Plaintiff shall file its new motion to seal by February 6, 2024; Defendants shall file any opposition by February 13, 2024; and Plaintiff shall file any reply by February 16, 2024. It is further ORDERED that Defendants shall respond to Plaintiff's #29 motion for a preliminary injunction within 7 days of the Court's resolution of Plaintiff's new sealing motion, and Plaintiff shall file its reply within 7 days after Defendants file their response. Finally, given Defendants' request that "the Court set a briefing schedule that does not overlap with Defendants' current deadline to respond to the 100-page Complaint, which is February 12, 2024," see ECF No. 45 at 7, it is further ORDERED that Defendants shall answer or otherwise respond to the complaint by March 1, 2024.
