MINUTE ORDER: Before this Court is Petitioner Dominican Republic's emergency ex parte motion for alternative service under Federal Rule of Civil Procedure 4(f)(3). See Def. Mot. for Alt. Servs., ECF No. #5 . Judge Colleen Kollar-Kotelly referred the motion to the undersigned for resolution pursuant to Local Rule of Civil Procedure 72.2(a) & (b) in advance of January 8, 2024. See December 29, 2023 Order, ECF No. #6 . Federal Rule of Civil Procedure 4(f)(3) allows the Court to issue an order authorizing alternative means of effecting service upon individuals in a foreign country. See Fed. R. Civ. P. 4(f)(3). However, it does not apply to individuals who have filed a waiver of service. See Fed. R. Civ. P. 4(f) (exempting service on a person whose waiver has been filed). That is because a party's waiver of service obviates the need to effect service in accordance with Rule 4(e), (f), or (h). See Fed. R. Civ. P. 4(d). Defendant Lee-Chin filed a waiver of service on January 3, 2024, see ECF No. #9 , thus eliminating the Dominican Republic's service obligations under Rule 4(f). Consequently, the Dominican Republic's motion is moot. For these reasons, it is ORDERED that the Dominican Republic's emergency ex parte motion for alternative service is DENIED WITHOUT PREJUDICE AS MOOT. Signed by Magistrate Judge Robin M.
