MINUTE ORDER. Pursuant to Fox v. Strickland, 837 F.2d 507 (D.C. Cir. 1988), the plaintiff is advised that failure to respond to the defendant's pending #8 Motion to Dismiss by February 12, 2024, may result in the Court (1) treating the motions as conceded, (2) ruling on the defendant's motion based on the defendant's arguments alone; or (3) dismissing the plaintiff's claims for failure to prosecute. The Clerk of Court is directed to mail a copy of this Minute Order to the plaintiff's address of record. So Ordered by Judge Dabney L. Friedrich on January 31, 2024. (lcdlf1) |
MINUTE ORDER. Upon consideration of the plaintiff's #10 Motion for Recusal, the motion is DENIED. Although the plaintiff "has an active administrative and quasi-judicial appeal" pending against Yale University, that appeal does not create reasonable grounds to question the Court's impartiality and will not bias the Court against the plaintiff. 28 U.S.C. 455(a)-(b)(1). Indeed, the Court was not aware of the plaintiff's appeal prior to her motion. Judges regularly hear cases with far less tenuous connections to their former law schools. See, e.g., Students for Fair Admissions v. President & Fellows of Harvard College, 600 U.S. 181 (2023). So Ordered by Judge Dabney L. Friedrich on January 31, 2024. (lcdlf1) |

MINUTE ORDER. Upon consideration of the plaintiff's #7 Motion for CM/ECF password, the motion is DENIED WITHOUT PREJUDICE. Under Local Rule 5.4(b), "a pro se party may obtain a CM/ECF username and password... with leave of Court. Whether of leave of Court should be granted is within the discretion of the judge to whom the case is assigned. To obtain leave of Court, the pro se party must file a written motion entitled 'Motion for CM/ECF User Name and Password,' describing the party's access to the internet, confirming the capacity to file documents and receive filings electronically on a regular basis, and certifying that he or she either has successfully completed the entire Clerk's Office on-line tutorial or has been permitted to file electronically in other federal courts." Here, the plaintiff's motion does not describe her access to the internet, confirm her capacity to file documents and receive filings electronically on a regular basis, or certify that she has successfully completed the requisite tutorial or has been permitted to file electronically in other federal courts. If the plaintiff files a new motion with the requisite information, the Court will be inclined to exercise its discretion so as to grant her leave to obtain a CM/ECF password. So Ordered by Judge Dabney L. Friedrich on January 19, 2024. (lcdlf1) |

MINUTE ORDER. Upon consideration of the plaintiff's #2 Motion for a CM/ECF Password, the Court will deny the motion without prejudice. Under this Court's Local Rules, "[a] pro se party may obtain a CM/ECF username and password from the Clerk with leave of Court. Whether leave of the Court should be granted is within the discretion of the judge to whom the case is assigned." At this time, the Court does not anticipate that a CM/ECF username and password will be necessary for the plaintiff. Accordingly, the plaintiff's motion is DENIED without prejudice. The Court will reconsider its decision after the defendants have been properly served. So Ordered by Judge Dabney L. Friedrich on January 2, 2024. (lcdlf1) |
