MINUTE ORDER: Before the Court is Petitioners' #2 motion to compel a third party's compliance with a subpoena issued pursuant to litigation in the U.S. District Court for the District of New Jersey. Petitioners represent that they served the third party, Lawrence West, with the copy of this motion. ECF No. 2-18. But West is not a party to this action, and to date, he has not sought leave to file any response to the motion. Indeed, neither the Petitioners nor the Respondent have filed anything on the docket since Petitioners filed their motion about six weeks ago. Therefore, it is hereby ORDERED that, by May 10, 2023, Petitioners shall file a status report informing the Court whether, as they request in the motion, West has already consented to litigating this matter in the District of New Jersey, and whether this case may be dismissed as a result. Signed by Judge Timothy J. Kelly on 5/3/2023. (lctjk1) |
