April 22, 2024 Filing 19 MOTION to Stay by ADAEZE NWOSU. (Attachments: #1 Exhibit)(zdp)
April 22, 2024 MINUTE ORDER. Upon consideration of Plaintiff's #19 Motion for Stay, it is ORDERED that the Motion is DENIED. The Court already denied Plaintiff's Motion for Recusal. See Dkt. 15. The Court will not stay the case based on Plaintiff's #12 Motion to Remand because the Court would like the parties to brief that Motion. Nor does the Court find it necessary to stay briefing on the Motion to Compel while the parties brief the Motion to Remand. Therefore, it is further ORDERED that the following briefing schedule shall apply to this case. Defendants shall file their response to Plaintiff's Motion to Remand on or before May 1, 2024, and Plaintiff may file a reply on or before May 8, 2024. Plaintiff shall file her response to Defendants' #17 Motion to Compel on or before May 20, 2024, and Defendants may file their reply on or before May 30, 2024. Because Plaintiff is proceeding pro se, the Court hereby advises Plaintiff of the consequences of failing to timely respond to Defendants' Motion to Compel. Cf. Fox v. Strickland, 837 F.2d 507, 509 (D.C. Cir. 1988) (per curiam). If Plaintiff does not file a response, the Court may treat the Motion as conceded. See D.C. LCvR 7(b). Or, if Plaintiff does file a response, the Court may treat as conceded any unopposed arguments that Defendants advance in support of the Motion. See Sandoval v. U.S. Dep't of Just., 296 F. Supp. 3d 1, 12 (D.D.C. 2017). SO ORDERED. Signed by Judge Ana C. Reyes on 4/22/2024. (lcar3) Modified on 4/23/2024 to correct document link (zcdw).
April 22, 2024 MINUTE ORDER. Because Defendants did not sufficiently redact Plaintiff's personal information included in her credit card statement and the purchases detailed within, see Exhibit B (pages 19-31) of Dkt. 18, it is ORDERED that the Clerk shall immediately place pages 19-31 of Dkt. 18 under seal. See United States v. Hubbard, 650 F.2d 293, 323-24 (D.C. Cir. 1980) (discussing particularized privacy interests to be weighed against public access). The Court expects Defendants in the future to err on the side of caution when determining whether to file personal information on the public docket or move to seal instead. Signed by Judge Ana C. Reyes on 4/22/2024. (lcacr1)
