MINUTE ORDER denying #4 Plaintiff's Motion in Opposition to Judge's Order to Dismiss. The court treats Plaintiff's motion as one for reconsideration arising under Federal Rule of Civil Procedure 59(e). Rule 59(e) motions are "discretionary and need not be granted unless the district court finds that there is an intervening change of controlling law, the availability of new evidence, or the need to correct a clear error or prevent manifest injustice." Firestone v. Firestone, 76 F.3d 1205, 1208 (D.C. Cir. 1996) (internal quotation marks and citation omitted). Plaintiff has not carried their burden. None of the other cases that Plaintiff cites from this District have allowed similar claims to proceed under the Alien Tort Claims Act (ATCA). Pl.'s Mot. at 1. Importantly, the United States has not waived its sovereign immunity against suit under the ATCA. See Escarria-Montano v. United States, 797 F. Supp. 2d 21, 24 (D.D.C. 2011). The remainder of Plaintiff's motion rehashes the same theory upon which suit was brought, and that theory remains insubstantial to confer federal question jurisdiction. Signed by Judge Amit P.
