November 13, 2024 Opinion or Order MINUTE ORDER granting in part and denying in part Plaintiffs' #5 Motion to Consolidate Cases, Appoint Interim Co-Lead Counsel and Liaison Counsel, and Set a Schedule for the Filing of a Consolidated Complaint. The Court hereby consolidates Cleary v. Georgetown University (No. 24-cv-2953), Daniels v. Georgetown University (No. 24-cv-3122), and Morrison v. Georgetown University (No. 24-cv-3139) under the docket and title of Cleary v. Georgetown University (No. 24-cv-2953). The parties shall make all future filings in Cleary and are advised NOT to elect the spread text option while filing in ECF. The Clerk of the Court is directed to administratively close Daniels and Morrison. At this stage, the Court will not retitle the case or consolidate any future action in this district arising out of the same or similar facts as the consolidated action. The Court will consider consolidation of any future related actions after providing the parties to any such actions an opportunity to be heard. Plaintiffs in the consolidated action shall file an operative, consolidated complaint by December 13, 2024. Defendant shall answer or otherwise respond within fourteen days of the filing of the consolidated complaint. Defendant's #9 Unopposed Motion for an Extension of Time to Respond to the Complaint is therefore denied as moot. The Court will deny without prejudice Plaintiffs' motion to appoint interim co-lead counsel and liaison counsel. Because Lowey Dannenberg, P.C., Shub & Johns LLC, and Tycko & Zavareei LLP, have been cooperating in these matters, there does not appear to be "rivalry or uncertainty" between multiple lawyers competing to represent the class that would warrant the appointment of interim counsel. Fed. R. Civ. Pro. 23 advisory committee's note to the 2003 amendment; see also In re LinkedIn Advert. Metrics Litig., No. 20-cv-08324 (SVK), 2021 WL 1599289, at *1 (N.D. Cal. Apr. 23, 2021) (denying motion to appoint interim class counsel because attorneys had "worked together" so the court saw "no danger to the interests of the putative class that appointment of interim counsel [would] remedy"); Sullivan v. Barclays PLC, No. 13-cv-2811 (PKC), 2013 WL 2933480, at *1 (S.D.N.Y. June 11, 2013) ("When a putative class action consists of a single case brought by two law firms working in apparent harmony, the rationale behind the appointment of interim class counsel is diminished."). Appointing lead and liaison counsel now would be premature in any case given that the alleged breach occurred only four weeks ago and counsel for other individual or collective putative class members may be waiting in the wings. See Sullivan, 2013 WL 2933480 at *1 ("Such an appointment could also preemptively limit a full airing and evaluation of the appointment of class counsel, in the event that additional, overlapping actions do, in fact, materialize in the future.").
