On its face, the Motion asks the Court to confirm that FRCP 81(c) applies in this case. The Court so confirms. However, the Motion also appears to ask the Court to give effect to the parties' private agreement to extend the deadline by which to file a responsive pleading. The Court will not do so, but will construe the Motion as a request for an extension of time. Plaintiff appears to oppose the Motion, though the Local Rule 3.01(g) certification does not explicitly say so. Therefore, Plaintiff is directed to respond to the Motion on or by May 6, 2020.
