ORDER: The report and recommendation 6 is ACCEPTED and ADOPTED. Plaintiff's construed motion for leave to proceed in forma pauperis 2 is DENIED WITHOUT PREJUDICE. Plaintiff is directed to either pay the filing fee of $400.00 or file a renewed motion for leave to proceed in forma pauperis on or before May 8, 2015. Plaintiff's Motion for the Appointment of Counsel 4 is DENIED.
