Filing 25 ENDORSED ORDER DENYING #22 Plaintiffs' Motion for Leave to File Amended Complaint. On April 23, 2021, this Court denied Plaintiffs' request to proceed in forma pauperis and dismissed this action on the grounds that it was plainly frivolous. (Dkt. 7) On May 3, 2021, Plaintiffs filed a Notice of Appeal, seeking to appeal this Court's Order dismissing the action. (Dkt. 9) Plaintiffs now seek leave to file an amended complaint. The request is denied because the filing of the Notice of Appeal divested this Court of jurisdiction to consider a motion for leave to file an amended complaint. See Green Leaf Nursery v. E.I. DuPont De Nemours & Co., 341 F.3d 1292, 1309 (11th Cir. 2003) ("The filing of a notice of appeal is an event of jurisdictional significance--it confers jurisdiction on the court of appeals and divests the district court of its control over those aspects of the case involved in the appeal.").
