REPORT AND RECOMMENDATION. For the reasons stated above, it is respectfully RECOMMENDED that Plaintiff's motion for leave to proceed in forma pauperis, ECF No. #2 , be DENIED. It is further RECOMMENDED that this case be DISMISSED with prejudice as the allegation of poverty is untrue and filed in bad faith, as malicious, and for failure to comply with a court order. The dismissal should count as a strike pursuant to 28 U.S.C 1915(e)(2)(B)(i). R&R flag set. Internal deadline for referral to district judge if objections are not filed earlier: 11/4/2024.
