Filing 7 PAPERLESS ORDER denying #3 Motion for Leave to Proceed in forma pauperis. The motion is Denied under 28 U.S.C. s. 1915(e)(2) that provides that "courts are permitted to dismiss a suit at any time [ ] the court determines that... (B) the action or appeal (i) is frivolous or malicious, (ii) fails to state a claim on which relief may be granted, or (iii) seeks monetary relief against a defendant who is immune from such relief." This action is a rehashed complaint of an action previously filed by the same plaintiff against many of the same foreign defendants that was dismissed as frivolous by District Judge Kathleen Williams (Case No. 17-20694). The appeal of that Order was also dismissed by the Eleventh Circuit.Now through this action Plaintiff seeks to reinstate the same claims that Judge Williams found were frivolous "because venue is not proper in this district and the Court appears to have no personal jurisdiction over any of these defendants, many of whom would be immune from suit. In short, Plaintiffs appear to have alleged that they are citizens of Japan, and while in Japan they were injured by certain Japanese entities and individuals. Plaintiffs have therefore alleged a case, if one exists, that belongs in Japan." [D.E. 20 at 2-3].Accordingly, the motion for in forma pauperis relief in this rehashed action is Denied as frivolous. If Plaintiff wishes to pursue his claims in this forum, the $400.00 filing fee must first be paid to the Clerk of the Court within fourteen (14) days, failing which the action will then be dismissed.
