December 14, 2022 Opinion or Order Filing 6 ORDER re #1 Petition for Writ of Habeas Corpus, filed by Pedro J. Ramos-Ramos This petition (ECF No. 1) and Action is TRANSFERRED to the United States District Court for the Southern District of Florida pursuant to 28 U.S.C. 1631 because it is in the interest of justice. A petition for a writ of habeas corpus pursuant to 28 U.S.C. 2241 ordinarily must be brought within the district of confinement. Rumsfeld v. Padilla, 542 U.S. 426, 435 (2004); see 28 U.S.C. 2242. At the time the petition was filed, Petitioner Pedro Ramos-Ramos was confined in the Southern District of Florida at FCI Miami. See Pet., ECF No. 1. While the Court is informed that Ramos-Ramos is no longer in the Southern District of Florida, see December 1, 2022 Letter ECF No. 5, it is in the interest of justice to transfer rather than dismiss the petition. This Court has no jurisdiction and therefore it is ultimately for the transferee court the court with jurisdiction over this matter -- to decide its own jurisdiction as to the petition. Furthermore, Ramos-Ramos has paid the $5.00 filing fee, and it is in the interest of justice to avoid unnecessary expense and delay in re-filing the petition if possible. Signed by Judge William G. Young on 12/14/2022.(EES)
