Filing 9 Joint SCHEDULING REPORT - Rule 26(f) by Andrew Perrong (Kaufman, Avi) |
Filing 8 PAPERLESS ORDER granting #7 Defendant's Motion for Extension of Time. The deadline for Defendant to respond to the Complaint (DE #1 ) was October 22, 2020. (DE #4 ). Defendant seeks a 14-day extension, citing that "[d]ue to a miscommunication between Defendant and its registered agent, Defendant did not become aware of this litigation until approximately October 7, 2020," and did not retain counsel until October 14, 2020. (DE #7 ). Additionally, Defendant states that "due to other professional obligations and a pre-planned trip," Defendant's counsel was unavailable from October 17, 2020, through October 20, 2020. (Id.). However, the Motion indicates that Plaintiff opposes the extension. (Id.). Although I have considered Plaintiff's opposition, this is the first extension sought by Defendant and this case was only recently filed. Therefore, under these circumstances and in light of the brief nature of the requested extension, I find good cause to grant the Motion. Therefore, the deadline for Defendant to respond to the Complaint (DE #1 ) is extended to November 5, 2020. No other litigation deadlines are modified or amended as a result of this Order. Given Plaintiff's opposition, I caution Defendant that I am not inclined to further extend this deadline absent a compelling showing of good cause. Additionally, the Court notes that Defendant's Motion for Extension of Time was filed on the date on which Defendant's Answer to the Complaint was due. Going forward, counsel must ensure that extensions are sought in advance of the deadline. Signed by Judge Donald M. Middlebrooks on 10/23/2020. (Answer due 11/5/2020) (kal) |
