The Court remains skeptical that Defendant's counsel needs 35 pages to brief a partial motion to dismiss. Counsel contends that its analysis is fact intensive, which does not typically bode well for a motion to dismiss, which would generally be based on the acceptance of the truth of Plaintiffs' allegations in the complaint with an analysis of the legal elements of the cause of action as alleged, as distinguished from a motion for summary judgment which may require more analysis as to what the record does and does not support. In any event, the Court has decided to reconsider its previous denial of Defendant's request and will grant counsel the extra pages she seeks. Counsel should be aware, however, that unnecessary verbosity is ineffective written advocacy. All unnecessary words, phrases, and paragraphs should be eliminated. This requires thorough revision, which the Court is confident will result in a brief substantially shorter than the 35 pages permitted.
