Plaintiffs filed a motion to file "certain exhibits" under seal because they "may be subject to the Protective Order." The motion for leave to file unspecified exhibits under seal is denied. The parties are reminded that under the 16/26 order, absent compelling circumstances, protective orders "do not apply to exclude evidence from public disclosure when that evidence is relied upon in support of or opposition to any motion or relevant issue in any hearing or trial. There is a presumption that any evidence relied upon in a filed motion or in opposition to any such motion or to be used in a hearing or trial shall be a public record. Accordingly, when materials are to be used in the foregoing manner, a party will not be allowed to file the materials under seal just because they are covered by a discovery protective order." If Plaintiffs wish to file exhibits under seal, they must specify which exhibits they want to file under seal and why those documents should be sealed. They must also follow the Courts administrative procedures for "Restricted Documents and Sealed Entries," which are detailed in the CM/ECF Administrative Procedures manual. Discovery materials that have already been filed with the Court -- such as depositions and exhibits Defendant has already filed -- should not be re-filed.
