ORDER: Accepting plaintiff's #4 assertion that he was unable to timely comply with the January 3, 2019, order because his mail arrived late, the Court will grant him another opportunity to file an amended complaint and to either pay the fees or submit a financial affidavit. IT IS THEREFORE ORDERED that plaintiff must, within TWENTY-ONE (21) DAYS from the entry date of this order, file an amended complaint and either submit the full filing and administrative fee of $400.00 or execute and return a financial affidavit seeking leave to proceed in forma pauperis. Plaintiff must comply with the specific instructions set forth in the January 3, 2019, order for filing a properly amended complaint. Plaintiff's #5 motion to appoint counsel is DENIED.
