ORDER granting in part and denying in part 37 Plaintiff's Motion for Summary Judgment as to Defendants' Counterclaim; denying in part 38 Defendants' Motion for Summary Judgment; and denying 44 Defendants' Motion for Leave to File Motion for Summary Judgment on the Counterclaim.
