Filing 36 OPINION and ORDER GRANTING Plaintiff's 13 Motion to Dismiss amended counterclaims. The Court GRANTS in part and DENIES in part Hoosier Eye Doctors 19 Motion to Intervene. The motion to intervene is granted as to Plaintiffs claims of trademar k infringement, unfair competition, dilution and cyber-squatting only. The court will not permit the intervention of Hoosier Eye Doctor to re-open the issue of De Spiritos now-dismissed counterclaims.
