The Motion is granted as to the declaratory judgment action seeking a declaration that First Intercontinentals claim is time-barred and as to the claim by Plaintiff and cross-claim by First Intercontinental for the $500,000 payment alleged to have been made on the first Proof of Loss. The Motion is denied as to the claim by Plaintiff and cross-claim by First Intercontinental for the $10,000 payment alleged to have been made on the second Proof of Loss.
