ORDER AND OPINION denying 55 Defendant's Motion for Summary Judgment on plaintiff's negligence claim and denying without prejudice defendants motion for summary judgment as to damages. The Court will allow the parties time to mediate thi s case, if they think it would be productive. The parties should advise the Court by Friday, March 1, 2013, whether they would like to attempt mediation and if they choose to do so, the parties will be given time to do so. If the parties do not wish to mediate the case, the plaintiff will be required to file a trial brief on the damages issue, only, by April 1, 2013.
