July 6, 2020 Opinion or Order Filing 365 ORDER - Trial in this matter is currently scheduled to begin on August 10, 2020. The parties anticipate they will need approximately eight days of trial just to submit their evidence. [Doc. No. #343 at 10]. Given the challenges of selecting a jury and holding a trial during the current COVID-19 pandemic, the court anticipates that the trial will last longer than the standard two-week jury term. As noted in the chief judge's fourth amendment to General Order 20-01, the average number of COVID-19 cases reported each day in Georgia remains high and the state of emergency as declared by the president remains in effect. June 11, 2020 Filing 360 Minute Entry for proceedings held before Judge Charles A. Pannell, Jr.: Pretrial Conference held on 6/11/2020. The court held a pretrial conference with counsel. Trial in this case is scheduled for August 10, 2020 and the court will notify counsel by July 17, 2020 as to whether the trial will proceed on that date. Counsel estimates that the total trial time will be 9-10 days. The court advised counsel that any trial over two weeks requires a special draw of jurors. So, if counsel can try the case within two weeks, then the trial will be timed and each side will be given 19 hours to present their evidence. After discussing the parties' proposed voir dire questions, defendant's counsel requested permission to submit a joint stipulation to define a qui tam action that can be provided to the jurors. The court approved the request. Argument was then heard regarding the plaintiffs' objection to the defendant's jury instructions. Plaintiffs' counsel stated that the instructions contradict an agreement made between the parties in email and the parties proposed pretrial order [Doc. No. #343 , 2]. Defendant's counsel stated that they do not deny that an agreement was made or that the agreement was made to motions in limine only, however they want an opportunity to stipulate as to why the government is not present at the trial. The court ruled that it will allow the plaintiffs to file motions in limine on the following three items: (i) the government's nonintervention or absence from trial, (ii) the fact that the False Claims Act provides for treble damages and penalties, or that it allows a successful relator to recover attorneys fees, expenses, and costs, or (iii) the familial relationship between Relator Natalie Raven and Relators counsel Louis Cohen. Plaintiffs' counsel is to file these motions within a week and time will be allowed under the rule for the defendant to respond. The court discussed the parties' proposed verdict form. Defendant's counsel advised the court of their intention to file a motion to revise the verdict form, however plaintiffs' counsel stated that they do not consent to any revision. The court then discussed whether the parties' will be providing a chart to the jurors regarding their demonstrative exhibits. Each side is to exchange their charts and make any objections prior to trial. The court stated that it recently made a ruling excluding the opinion of the plaintiff's rebuttal expert at trial but will allow the plaintiffs to file a motion for reconsideration regarding that ruling.
