Filing 113 ORDER granting MBC's 89 Motion to Join and Adopt AME's Motion for Summary Judgment, and Defendants' 79 Motion for Summary Judgment is GRANTED, part part and DENIED, in part. Plaintiff's declaratory judgment, alter ego, and a ttorney's fees claims remain, and Plaintiff's fraud and conspiracy claims are dismissed. Accordingly, Defendant AME's 62 Motion to Dismiss Counts 4 and 5 is DENIED as MOOT. This Court also REFERS this action to the Chief Magistra te Judge Janet F. King for magistrate assignment to mediate this matter.
