Filing 22 ORDER AND OPINION granting 17 Defendants' Motion to Dismiss Plaintiff's Amended Complaint. Specifically, Plaintiffs claims under 42 U.S.C. § 1983 for violation of their rights to equal protection (Count Three) and procedural and subs tantive due process (Count Four), are DISMISSED WITH PREJUDICE; as a result, all federal claims asserted against the City of Atlanta and the individual defendants are DISMISSED WITH PREJUDICE. The Court DECLINES to exercise supplemental or pendent jurisdiction under 28 U.S.C. § 1367(c) and thus Plaintiffs state law claims (Counts One, Two, Five, Six and Seven), those claims are REMANDED TO THE SUPERIOR COURT OF FULTON COUNTY.
