OPINION AND ORDER that Plaintiff Prudential Insurance Company of America's and Defendants Sharon Davidson's, the Estate of Frank W. Davidson's, Matthew T. Davidson's, and Bryan James Davidson's Joint Motion to Interplead and Dismiss Plaintiff The Prudential Insurance Company of America with Prejudice 11 is GRANTED. Plaintiff Prudential Insurance Company of America is granted leave to submit the interpleaded funds of $568,000.00, together with applicable accrued in terest, to the Clerk of Court within twenty-one (21) days of this Order. The Clerk of the Court shall deposit this amount into the Registry of the Court. IT IS FURTHER ORDERED that Plaintiff Prudential Insurance Company of America, upon deposit of the interpleaded funds, is DISMISSED WITH PREJUDICE from this action and discharged from any and all liability to the Defendants relating to the Plans or the Death Benefits. IT IS FURTHER ORDERED that Cross Defendant Sharon Davidson'sMotion f or Summary Judgment 14 is GRANTED IN PART AND DENIED IN PART. Cross Defendant Sharon Davidsons Motion for Summary Judgment is GRANTED with respect to Count Eight and DENIED with respect to Counts One, Two, and Nine.
