ORDER (by docket entry only): This case is before the Court on the Parties Consolidated/Joint Discovery Statement (Doc. 47). The Parties dispute whether the discovery period has commenced already. This Courts Local Rules provide that [t]he discovery period shall commence thirty days after the appearance of the first defendant by answer to the complaint, unless the parties mutually consent to begin earlier. LR 26.2. In this case, as Defendants Motion to Dismiss (Doc. 42) is pending, Defendant has not filed an Answer. The Parties clearly did not mutually assent to begin discovery earlier. If the claims proceed after the Court rules on Defendants Motion to Dismiss, discovery will begin in accordance with the Parties Joint Preliminary Report and Discovery Plan (Doc. 40.)
