As a United States Magistrate Judge, I may enter a default judgment only if the Mitchells consent to my exercise of jurisdiction over this civil action. See 28 U.S.C. 636. If the Mitchells wish to consent, they should complete and file Form AO-85, see www.gand.uscourts.gov/commonly-used-forms (Consent to Proceed Before Magistrate (AO-85)), and I will schedule a default judgment hearing on a date convenient for them in August 2021. If the Mitchells prefer to proceed before Judge Cooper, they may do that and schedule a hearing date with his Chambers. Whether the Mitchells elect to proceed before Judge Cooper or me, it is necessary that they provide additional information in advance of the default judgment hearing. I therefore ORDER the Mitchells TO SUBMIT NO LATER THAN AUGUST 12, 2021, a prehearing filing containing the information required by Civil Local Rule 16.4(B)(1), (3), (4), (13), (14), (17), (18)(a)&(c), (19)(a), (20), (21), (26) & (28). Filing 69 REPORT AND RECOMMENDATION re #3 Amended Complaint, filed by Christin Mitchell, Dwane Mitchell. I RECOMMEND that judgment be entered in favor of Village Capital, the FDIC, and Dunn. Because the Mitchells have done nothing since September 13, 2019, to convert the entry of default against Thomas into a default judgment, see Fed. R. Civ. P. 55(b); LR 55.1, NDGa., I ORDER the Mitchells, within fourteen days of the entry date of this Report and Recommendation and Order, either to (A) apply for a default judgment or (B) show cause otherwise why the part of the case that remains open with respect to Thomas should not be dismissed for want of prosecution, see LR 41.3(A)(3), NDGa. If the Mitchells apply for a default judgment or respond to the order to show cause within the time prescribed above, I will conduct further appropriate proceedings. In the alternative, if the Mitchells do not apply for a default judgment or show cause otherwise why dismissal is not appropriate within the time prescribed above, I RECOMMEND that the Court also DISMISS this case as to Thomas for want of prosecution, see LR 41.3(A)(3), NDGa., and CLOSE it.
