January 22, 2019 Opinion or Order Filing 2 ORDER - Plaintiff has filed this action under the Fair Debt Collection Practices Act, and the Clerk of Court is DIRECTED to adjust the Court's docket to show that this prisoner action is brought under 15 U.S.C. 1692. If Plaintiff wishes to proceed without prepayment of the filing and administrative fees, he must provide a properly completed financial affidavit and certified prison account statement as instructed further below. Plaintiff is cautioned that, even if he is allowed to proceed in forma pauperis under 28 U.S.C. 1915(b)(1), he must nevertheless pay the full amount of the $350.00 filing fee from his inmate account. If Plaintiff does not wish to have funds deducted from his inmate account, he is INSTRUCTED that, within THIRTY (30) DAYS of the entry date of this order, he should file a Notice of Voluntary Dismissal which clearly states that he voluntarily dismisses this action. If Plaintiff does not choose to voluntarily dismiss, IT IS ORDERED that Plaintiff must, within THIRTY (30) DAYS of the entry date of this Order, either submit the full filing and administrative fees of $400.00, or execute and return a financial affidavit seeking leave to proceed in forma pauperis. Further, Plaintiff is DIRECTED that he must keep the Clerk of Court advised of his current address at all times while his case is pending. Plaintiff is CAUTIONED that his action will be subject to dismissal if he does not comply with the Court's Order to pay the required fees or to apply for in forma pauperis status or if he does not comply with the Court's direction to keep the Clerk of Court advised of his current address at all times while his case is pending. The Clerk of this Court is DIRECTED to forward Plaintiff the appropriate financial affidavit, together with a copy of this Order. The Clerk is further DIRECTED to RESUBMIT this action to the assigned Magistrate Judge upon receipt of the filing and administrative fees or affidavit or at the expiration of the aforementioned thirty-day time period.
