April 11, 2019 Opinion or Order Filing 6 ORDER TO SHOW CAUSE: Petitioner is ORDERED to show cause why this action should not be DISMISSED for failure to obey the Court's orders and failure to prosecute pursuant to Federal Rule of Civil Procedure 41(b) by filing with the Clerk of Court within FOURTEEN (14) DAYS of the date of this Order a written response explaining his failure to comply with the orders of this Court and including with his response the amended complaint ordered by the Court on March 13, 2019. Petitioner is admonished that failure to respond within the specified period of time may result in the dismissal of this action pursuant to Local Rule 41.3(A)(2). The Clerk is hereby DIRECTED to resubmit this action to the undersigned Magistrate Judge seventeen (17) days from the entry date of this order. Signed by Magistrate Judge Russell G. March 13, 2019 Opinion or Order Filing 5 ORDER: IT IS ORDERED that petitioner must, within TWENTY-ONE (21) DAYS of the date of this order, submit a second amended petition. Petitioner is DIRECTED to identify by name his immediate custodian-the Warden of Smith State Prison-as the proper respondent to this action, complete in detail the habeas corpus form petition provided to him by the Clerk of Court with this Order. IT IS FURTHER ORDERED that, also within TWENTY-ONE (21) DAYS of the date hereof, petitioner must either pay the entire filing fee of $5.00 or execute and return the financial affidavit that will be provided to him by the Clerk of Court with this Order. The Clerk SHALL stamp the civil action number on a copy of this Court's 28 U.S.C. 2254 habeas corpus form and forward the form and the appropriate financial affidavit to petitioner, together with a copy of this Order.
