Filing 3 ORDER that plaintiff must, within THIRTY (30) DAYS of the date of this order, either submit the full filing and administrative fee of $400.00, or execute and return a financial affidavit seeking leave to proceed in forma pauperis that includes (1) an authorization allowing his custodian to withdraw funds from his inmate account and (2) a completed certificate signed by an authorized institutional officer regarding the current balance in his inmate account. Plaintiff is CAUTIONED that, even if he is allowed to proceed in forma pauperis, pursuant to 28 U.S.C. 1915(b)(1), he must nevertheless pay the full amount of the $350.00 filing fee from his prisoner account. Plaintiff is required to keep this Court advised of his current address at all times while this lawsuit is pending. The Clerk of the Court is DIRECTED to change the style of the case to reflect that it is filed pursuant to 28 U.S.C. 1331, rather than 42 U.S.C. 1983, see [Doc. 1 at 3], and to forward the appropriate financial affidavit to plaintiff together with a copy of this Order. The Clerk is further DIRECTED to resubmit this action to the assigned Magistrate Judge upon receipt of the full filing and administrative fee or affidavit or at the expiration of the time period noted above.
