Defendant requested that the Court compel the production of documents and interrogatory responses in the following categories: 1) Medical Records; 2) Economic Losses from Endorsements; and 3) Defendant's Alleged Disclosures. Regarding the issue of medical and mental health records, Plaintiffs agreed to produce all the requested mental health records and a HIPAA release as to any mental health providers. Plaintiffs are withdrawing their contention that they suffered medical injuries as part of their damages. The Court found that the record did not justify Defense counsel's request for all medical records for the past 10 years. The parties agreed to allow for medical-related questioning during depositions with the possibility of additional discovery if more information is obtained. Regarding the second issue of lost endorsements, the Court ordered that, if Plaintiffs claim that specific endorsement deals were lost, that information must be provided to Defendant. The parties disagreed on whether that information had already been provided. The Court ordered Plaintiffs' counsel to supplement their discovery responses to include the company names, dates, amount lost, contact names, and documents relating to the deals or to show that that information had already been disclosed. In respect to the third issue relating to Defendant's alleged disclosures of confidential tax information, Plaintiff does not object to providing the requested information. Plaintiffs' counsel is instructed to produce or to supplement their discovery responses with all the information they have on this subject, including the contact information of witnesses. Plaintiffs' counsel will supplement their discovery responses with the above information discussed during the telephone conference. The Court ordered the parties to confer and propose deadlines for discovery and to provide the Court with a proposed scheduling order.
