ORDER - Plaintiffs and the wHydrate Defendants have emailed the Court with various disagreements as to the protective order. After reviewing the emails, the Court rules as follows: 1) The Court rejects the definition of "Confidential Information" in the draft protective order as overly broad. The Court will not give the parties permission to designate all documents produced in this litigation as confidential. Instead, the parties must use a definition of "Confidential Information" that actually defines what documents are legally confidential. 2) The Court is not concerned as to the process of sealing confidential documents for hearings and filings in the proposed protective order. The Court will determine if any document used in a hearing or filed should be sealed if any party asks the Court to seal it. 3) The protective order should contain a provision allowing a non-party to the Fulton County litigation to object to automatically sharing their confidential information in that litigation. A telephone conference was held to address the parties' discovery dispute regarding Plaintiffs' request for a forensic evaluation of Defendants' email accounts and electronic devices.
